1. Scope
These Terms & Conditions apply to all purchases of online courses and live online classes offered by magicGerman through magicGerman.net. By placing an order, you agree to these Terms.
2. Courses and Online Classes
We offer digital courses and live online classes, including classes conducted through Zoom. Course content, dates, times, duration, and access conditions are described on the relevant course page.
3. Registration and Payment
You must provide accurate information when registering. Prices are displayed on the website. Payment must be completed using the available payment methods before access to the relevant course or class is provided.
4. Digital Content and Access
After successful payment, you receive access to the purchased digital course for the period specified on the course page. Access is personal and may not be shared, transferred, copied, or resold without our permission.
5. Live Classes
Live classes are generally held via Zoom. You are responsible for having a suitable internet connection, compatible device, and a Zoom account and app. We are not responsible for interruptions caused by your equipment, internet connection, or third-party services.
6. Cancellation and Consumer Rights
Consumers have the statutory rights applicable to online purchases, including any applicable 14-day right of withdrawal. To exercise your right of withdrawal, you must inform us by a clear statement, for example by email, before the withdrawal period expires.
All digital courses are made available immediately after purchase. By placing an order, you expressly consent to the immediate delivery of the digital content and acknowledge that your statutory right of withdrawal ends once delivery of the digital content begins, to the extent permitted by applicable law.
For live classes booked for a specific date or period, any statutory exceptions to the right of withdrawal that apply under applicable law will apply. For live classes scheduled to take place within the 14-day withdrawal period, your right of withdrawal ends once the class has taken place
7. Cancellation by Us
We may cancel or reschedule a live class where reasonably necessary. If we cancel a class and cannot provide a suitable alternative, you will receive any refund required by applicable law. If you do not attend a booked live class or request to reschedule less than 24 hours before the scheduled start time, no refund will be provided unless otherwise required by law or agreed with us.
8. Intellectual Property
All course materials, videos, documents, presentations, and other content remain our intellectual property or are used under appropriate licenses. They may not be reproduced, distributed, recorded, published, or commercially exploited without prior permission.
9. Recording and Conduct
Unless expressly stated otherwise, participants may not record or redistribute live classes. Participants must behave respectfully and must not disrupt classes or misuse access to the website, courses, or Zoom sessions.
10. Account Termination and Misuse
We may suspend or terminate an account if it is used in violation of these Terms, including sharing account access, unauthorized distribution of course content, or other misuse of our services. In such cases, no refund will be provided.
11. Liability
We are liable for the proper provision of our online courses and services in accordance with applicable law. We are not liable for temporary interruptions, technical problems, or failures caused by circumstances outside our reasonable control, including internet connections, third-party platforms, hosting providers, or payment services. Nothing in these Terms limits liability that cannot legally be excluded or limited.
12. Changes
We may update these Terms where necessary. Changes will not affect orders already placed unless required or permitted by applicable law. We may change our pricing and course availability for future purchases. Course content may also be updated or modified at any time to improve or maintain the quality of the course.
